ABSTRACT

The construction business is a 1.7 trillion dollar business globally, totalling up to 5% to 7% of the gross domestic product for most nations. It is responsible for a substantial component of worldwide total capital structure. The construction business's responsibility in trade and industry growth is unquestionable; property, road and rail network, public utility systems, educational institutes and medical institutions are all constructed resources. Since construction and infrastructure development has a fundamental function in growth of the country, corruption and fraud in the industry can be particularly destructive. How the construction contracts are handled depend on specific characteristics such as the type of work and client. When working with private clients, the constructor negotiates directly about the scope of work and price. The client establishes a requirement that the builder must comply, and it is this which sets the price of the work. The price is not very variable, but is influenced by the free market and competition. The risk of the owner finding another constructor who offers lower price depends on the bond of trust between the client and the constructor. This scenario becomes completely opposite when the client is the country or the government of a particular country. As the work is publicly funded, there are laws that govern the procedures for a constructor to establish a contractual relationship with the government such as having legal status, economic and financial capacity, technical capacity, and so on. In government contracts, the contract bidding occurs and the contractor who offers the lowest bid wins the bid, depending on the nature of work and technical ability. The purpose of the study is to discover the challenges faced by the Indian contractors with government as client.
