Summary

Age discrimination at workplace has become a growing issue and controversial concern today. Considering this, the article which I have chosen is “Fired for Being Too Old? Know Your Rights”, published at Fox Business on October 9, 2012. This article basically talks about how difficult it has become for older workers, who are victims of age discrimination, to prove and win the case of age discrimination against employer. Article states that age discrimination not only impacts older workers financially but also hurt them emotionally. However, feeling like a victim and being able to prove that you have become the victim are two different things.

According to this article, in 2009 ruling, Supreme Court has changed the legislation which has made it very difficult for age discrimination victims to win the case in court, because now the older workers have to show that their age is the deciding factor in an unfavorable employment decision. The article further refers the case of Jack Gross, whose two senators have introduced a bill in order to reverse the age biasness ruling by court and to restore the older worker's rights. But article states that according to the Civic Impulse, there is just one percent chance for this bill to be enacted.

Further, it states that the victim of age discrimination have to gather evidences of proof which clearly indicates the claim. This type of clear evidence can make a person win the case, however, it is really impossible to get such evidences against employers. Similarly, a victim has to gather up the documents legally for using it as a proof against employers. Thus, if victim wants to win the case, he/she needs to get clear cut evidence and that too legally.

The article further states that once you get goods, you need to file charge of age discrimination with the EEOC, which can take couple of years for the claim to work its way through the system. If you get a severance package from your former employer, you can forget about the case or else still you can sue, it all depends on your decision.
