Letter of Advice & Application for Divorce-Katie Homes

Letter of Advice

Dear Katie Homes

You have instructed us that you want to divorce your husband Thomas Crooze with whom you got married on 16 October 2001. In addition to filing an application for divorce, you also want to take out some sort of restraining order against him since he has been harassing and troubling you. According to the facts and details of your case, you have been married since 16 October 2001 with Thomas Crooze. You have two children from the marriage, both are girls born in 2007 and 2010. First time when you and your husband got separated when he moved out of the home was on 28 June 2012. He came back on 25 December 2012 and you both started your relation as husband and wife again. Then on 12 March 2013, you and your husband Thomas Crooze got separated again but under the same roof. Eventually on 31 May 2013, your husband left the home and ultimately you both got separated again. After that you entered in a new relation but since then your husband Thomas Crooze has been harassing and troubling you. On the basis of above mentioned facts and details you want to file an application for divorce from your husband Thomas Crooze and also wants to take some kind of restraining order against him for his troubling acts.

My advice for you in this case is provided in the below discussion.

You will be required to complete the application form for divorce attached with this letter. The fee for filing an application of divorce in the court is $800. There is also a reduced fee for divorce of $265, but reduced fee is granted only if you hold some concession card from government or if you can prove the financial destitution. The payment of the filing fee can be made through cheque, money order, debit or credit card of Visa or MasterCard. However, if you have a debit card other than the mentioned ones, you will have to pay in cash or in person through the available debit card. The completed form of application for divorce can be submitted and filed in the court electronically via using the portal of commonwealth courts. The link to the portal is www.comcourts.gov.au. For submitting the application in person or via post, the application can be submitted at any of the nearby family law registries in the New South Wales.
