Gay Marriage: should it be legally allowed or not?

Introduction

In my opinion yes it should be legalized as many of the supporters are also in favor. There are some reasons which states that now it should be legalized, in order to give respect to this community. The reasons I would like to make my point of view clear are discussed in the later pasrt of the study. For laws regarding homosexuality are commonly referred to laws that restrict or completely prohibit indicate a criminal intercourse between persons of the same sex and the laws that allow the formal registration of volumes of two persons of the same gender, and legal treatment of their parenthood. This legislation is not usually tied to the actual sexual orientation of the participants. Directly to the homosexual and other sexual orientation whether perceived or real may be subject to laws that protect against discrimination on grounds of sexual orientation. Also, they usually do not operate effectively with sexual orientation determined person, but with the motivation of the offender and even imaginary to the group membership of the injured persons.

Discussion

Gay marriage is a marriage between persons of the same sex. Gay marriage should be distinguished from the same-sex civil partnerships and other forms of same-sex unions that are legally distinct from marriage and often have significant limitations when compared to marriage. The registration of marriage the pair consolidates various specific rights: the right to joint property, the right to alimony, the right to inheritance, social and health insurance, preferential taxation and credit, the right to a name, the right not to testify in court against a spouse, the right of the trustee to act name of spouse in the event of his incapacity due to health, the right to dispose of the body in case of death of a spouse, the right to co-parenting and foster care and other rights not enjoyed by non-registered couples (Boswell, 14-26).

Opponents of gay marriage point out that according to tradition and religious norms may enter into marriage only between man and woman, and therefore the requirements of gays and lesbians grant them the same rights are absurd and we are not talking about equality of homosexuals and heterosexuals and homosexuals to provide new unprecedented rights. In the vast majority countries such marriages are not legally recognized (Anderssen, 335-351).

Supporters of gay marriage argue that marriage registration is a legal action, regardless of religious norms (in most modern legal state and church decoration marriage are separate), and that the law should follow the social changes that lead to the elimination of inequality between people as and occurs in the last century, when to phase out the previously existing restrictions on the registration of marriages; for case in point, between spouses, belonging to different social classes, religions or races (Dexter, 19-24).
