Introduction

Today the trend of the world keep continues towards the mobilization and globalization. The visa and immigration laws are also increasing with the widening of European Union. These changes are playing the essential role in the process of migration and creating numbers of problems for migrants to extend their visa. The migrant workers face challenging issues regarding the time frame. The personals involved in the recruitment process faces greatest challenges as they worry that if any changes in the immigration law take place it will create additional pressure for the migrant for extending visa. (AMNESTY INTERNATIONAL. 2005). Employers who sponsor the migrant workers can have a very significant effect duet to changes in the immigration laws of USA. The workers and the citizens of the European Union have the equal right to work in the United States of America, Only if they are not from the succession states such as Czech Republic, Latvia Hungary, Estonia, Poland Slovakia, and Lithuania. The workers from these countries need to register themselves under the Worker Registration Scheme, only if they want to work more than a one month.

Background

Before moving Further let's have close look at the background of the United States of America Immigration categories and process to know that how it works. The Home office of the United States of America announced the five year strategy plan for the Immigration in February 2005 in which there was a review of services and structure of the Immigration. (GUILD, E., 2009). After this review, the Immigration of United States of America has been switched towards the point based system; under this system individual applicant has to score some points for qualifying the United States of America visa. The reason and obje4ctive behind setting such a setup are to make the immigration system more transparent and specific so that it can deal with the problem of the non-compliance. The changes have been divided in to the five tier categories.

Tier 1 - Highly Skilled Migrants

Tier 2 - Skilled Workers

Tier 3 - Low-Skilled Workers

Tier 4 - Students

Tier 5 - Temporary or Exchange Workers

The each tier category is then distributed into sub categories for tackling the different migration needs and cases. I will discuss only 2 categories of Tier, Including Tier-2 and Tier-4 as this case is related to only these two Tiers. The most essential change in the Immigration process has taken place in the Tier-2 which eliminates the work permit system in the United States of America. Under the Tier-2 worker can have the permit for working in the United States of America.
