A Significant Issue Faced by the Justice System

Introduction

The U.S. is the world capital of prisons. Only one state, Louisiana, the incarceration rate in relation to the state's population is 13 times larger than that of China and five times that of Iran. The mass incarceration is not random but coordinated and improved reaction against the success of the civil rights movement. Racial segregation laws were made illegal. And immediately were created new legal means to segregate and destroy the black community in the U.S. The U.S. obsession with the punishment has always been cause that caught the attention of the media, when it is too blatantly unfair, or procedural defects or evidence shows very clearly racism. But these details become less important if one considers the endless horror that is the justice system in the U.S..

It is not uncommon for prosecutors broaden the list of charges against the defendants, forcing many to plead guilty in an attempt to escape from decades of incarceration. It is as if the state prosecutors in Florida had decided that it would not be necessary to follow all steps of fair legal process. Simply increasing the crimes of which the defendants are accused, asking sentences gigantic, five, ten, sometimes 20 times longer than the sentences provided in case the accused plead guilty, that is, in case the accused 'confess' - and the work of the entire judicial system is very easy.

What we see in U.S. courts has nothing to do with justice system that, by definition, always give the accused the right to be tried by judge legal, assisted by legal counsel, without fear, for no reason, end up sentenced life imprisonment (Vazsonyi & Pan, 2010; McCarter, 2011). The justice system punishes the U.S., where more innocent people declaring themselves innocent.
