The Criminal Procedures

In the High Court, process to appeal against the sentence or conviction

The court of magistrates has the Limited powers when dealing with the civil cases such as; family matters. Thus, the appeals related to the civil matters from the court of magistrate are proceeding by the High Court. The county courts deal with the 90% of the civil disputes. The county courts are also called the small courts to claim. The county courts also deal with the civil cases includes the monetary claims that are over around £15,000. The appeals made against the county courts for the civil matters are made dealing with the high court.

There are cases where the county courts are given extra power such as the family proceedings, divorce cases, bankruptcy cases, children matters in case of parents divorce or separation and many more. The civil claims that are more substantial are addressed by the high courts. The monetary cases up to £25,000 are heard by the high court which has three divisions. The division of queen bench, the chancery division, and the family division (Ridge & Baldwin, 1964).

The division of Queen's Bench

This division deals with all such cases and contract disputes involving claims of negligence, libel or defamation cases (Ridge & Baldwin, 1964).

The Chancery Division

This Division deals with all such cases and disputes involving the land claims, wills, properties or companies (Ridge & Baldwin, 1964).

The Family Division

The Family Division deals with all such cases and family matters including divorces, children custody cases as well as issues related to the welfare of children (Ridge & Baldwin, 1964).

The appeals for the civil matters from the High Courts are made for proceedings to the Court of Appeal, in the civil division. The law only and not the facts related to the case. When Appeals are made for matters involving the cases that have the legal importance, then, they directly deal with House of the Lords. The Courts of Appeal's Division of Civil matters is made to hear appeals from the sentences in the High Court (Carter, 2001, p. n. d). The House of Lords is made to proceed and hear the civil appeals that are made against the Court of Appeal that have concerns related to laws or facts. The House of Lords is also the final court for appealing in United Kingdom for civil disputes (Seraphim, 2008).

My Views for the proposal of removing the right to appeal in the High Court

As proposed by the ministry of justice for eliminating the right to appeal before the High Court, I support the proposal for the stated cases and the judicial reviews. At first I think it has to be done because it makes the process complex and lengthy by adding another court in rehearing process. Secondly I think the process of appealing can be more advantageous if the appealing of the court of the magistrate and the crown courts are reviewed for improvements.
