Introduction

Abortion is indeed a very sensitive issue for the women as she is exposed to numerous challenges all at the same time. There is a long debate if the women should be allowed to have abortion since the state holds the right to restrict the opportunity and permit it only in case of medical insurgence and incest. However, the case of Roe v. Wade has imposed immense impact on the society that eventually reflected upon another case that was Planned Parenthood v. Casey. The evaluation of argument if it should be made legal to abort continues to divide the Americans after the decision of the U.S Supreme Court. Some of the people are in the favor that abortion should be legalized as it is a power that should be never is limited by the government or any of the authority whether religious. The opponents or the people that are against this argument complain and argue that abortion is the murder of the innocent human being which should not be legalized. However, there are several circumstances which may not lie under the defined category yet still requires having the facility. This paper aims to explore the standing of the Supreme Court if it was the right decision and also gauging its impact on the society.

Roe v. Wade

According to Daly (1995), in 1973, the Supreme Court passed its ruling over the case of Roe v. Wade. The court at last out rooted the Texas Abortion Law. The ruling was an outcome of more than one case in those times. The court examined all the possible implications that could improve the situation. The court had already defined three trimesters that provided with a comprehensive framework for the easy interpretation of the law. In the first trimester of pregnancy that state does not have the authority to intervene since the decision is resided solely in the hands of the medical team and their decision is given priority in any case. In the second trimester, state may intervene when it comes to the provision of protection to the health of a woman. In the third application, the state has the authority to prevent abortion unless it contradicts with the first two trimesters. On total, there were immense check and restrictions on acquiring the legal status of abortion.

In the ruling, the Supreme Court gave verdict that a constraints on abortion appeared to be a clear violation of the “Due Process Clause of the 14th Amendment”; it tends to guard the Right of Privacy. Implications and acquiring of privacy is the mandatory right of every individual. The opinion of the court in the case of Roe gives respect to personal freedom and renders sufficient autonomy to the women as to terminate her pregnancy.
