Introduction

The law which will be discussing in this paper is death penalty. It is a type of capital punishment. The existence of capital punishment in the United States is one of the most controversial topics both nationally and internationally of the legal system of the United States. Responsible for their enforcement as well as their imposition in most cases the states because the federal government alone in matters of military justice, and has a few criminal matters under federal law on criminal competencies. Since the end of a moratorium in 1976 in the United States 1271 people were executed.

Thesis Statement

The main theme of this paper is to analyze and compare death penalty in Florida to a state that doesn't not have or take this punishment seriously according to the laws of United States of America.

Statement of the issue

Since the reintroduction of capital punishment in 1976 it was 16 of 50 states and the District of Columbia abolished, most recently in Illinois in March 2011. In several states it is no longer enforced. But can federal courts in states that have even abolished the death penalty in cases where applicable nationwide criminal provisions are applicable (federal crimes), the death penalty, most recently in 2003 in Boston ( Massachusetts ) against Gary Sampson for the murder of two drivers. Even the bombing of Oklahoma City bomber, Timothy McVeigh, was convicted by a federal court.

On 16 April 2008, the Supreme Court in the case of Baze v. Rees principle of the admissibility of the execution by lethal injection and pronounced them constitutional. The plaintiffs, two death row inmates from Kentucky, had claimed that this was a "cruel and unusual punishment" in violation of the Eighth Amendment to the U.S. Constitution.

Although the death penalty as such is not the decision stand, the trial took place in view of the fact that lethal injection is used in 37 out of 38 the death penalty, executing states as the primary method of execution, great attention and sparked a debate about possible alternatives. After the Supreme Court in September 2007 decided that he will accept the case, all executions were released in the United States. After deciding they were resumed, first on 6 May 2008 in Georgia with the execution of the death sentence against William Earl Lynd.

Of all the U.S. states with the death penalty, the New Mexico was, until 2009, the only one not having the real life alternative to the death penalty, but also one of the most skeptical of the application of capital punishment. In 1986, the Governor Toney Anaya even had pardoned all those convicted before leaving office because of his opposition to the principle of the death penalty.
