Introduction

An immigration policy is a policy within the state, which deals with the transfer of persons cross its boarder country, but particularly to those who are inclined to work and to remain in the country. Immigration policies can have no restriction over foreigner to migrate. U.S. immigration policy is influenced by several factors that hinder the development of effective, strategic decisions in this area. Such factors include, in particular, the impact of volatile public mood, lack of understanding of social and economic nature of immigration, the current practice of the indigenous population of the country favored at the expense of foreign visitors (nativism), as well as a variety of narrow political considerations. Among those one of the policies enacted was for H-1B Visa. It is regarded to be nonimmigrant visa in the United States lies in the Immigration and Nationality Act. This type of visa is issued in a sense of allowing U.S employers to go for hiring temporarily foreign workers in specialty occupations. In case of foreign worker, who is working in H-1B status quits or is dismissed among the sponsoring employer, worker has feasibility to shift to another nonimmigrant status, look for another employee or shift from United States.

Concern about U.S immigration policy is majorly focusing towards on its influence on the low-wage labor market. At the initial time of year 1980s, the scope of immigration policy focused on the issue of increasing the issue of temporary workers, highly skilled and qualified, who boast talent, education and training as par to their America counterparts. This results into increasing fear of foreign workers replacing American counterparts. This increasing awareness of H-1B visa program and debate reveal whether to encourage this program or not. Initially it was reveal that to overcome domestic labor shortages required to increase foreign workers. So, they initiated H-1B visa programs for increasing foreign labor. There was also news spread that labor shortages is just an excuse, but actually it is for getting cheaper foreign labor to reduce cost. H-1B Visa Program enables American industry to have foreign labor force at work and reduce their costs. Introduction of H-1B Visa enables company employers to recruit temporary workers from foreign countries, and, bringing skilled and highly qualified work in workforce in reducing their overall cost.
